Corporate Data Protection from Seizure: What to Do in Advance

According to Russian Interior Ministry data, tens of thousands of searches are conducted at commercial organisations annually. Seizure of servers, laptops and smartphones is standard procedure. The only way to preserve access to data is to prepare in advance.
What Happens to Data When Equipment is Seized
During investigative actions, law enforcement authorities may seize any equipment that may contain evidence. The return procedure can take from several weeks to several months. For most companies, this means complete or partial business shutdown.
Three Levels of Protection
Level 1. Data Encryption. Full disk encryption (FDE) makes data unreadable without the decryption key. Even with physical seizure of a server, the contents remain inaccessible. For personal data processing, it is recommended to use GOST algorithms and FSB-certified tools — CryptoPro, ViPNet.
Level 2. Geographic Data Separation. Sensitive data stored in a datacenter under European jurisdiction (Germany, Czech Republic) is inaccessible for seizure under Russian investigative proceedings. This is a legitimate protection measure used by many international companies.
Level 3. Backup and DR Plan. Current backup copies of data on isolated platforms allow restoring operations within hours, not weeks. It is necessary to test restoration regularly — at least quarterly.
What Does Not Help (Common Misconceptions)
- ✗Physical destruction of data during a search — this is obstruction of justice, criminal liability
- ✗Moving data to employee personal devices — they can also be seized
- ✗Hoping that "we won't be touched" — searches are conducted not only against direct suspects
- ✗Passwords without encryption — investigators have technical password-cracking tools
Key Principle
Protection from seizure rests on two pillars: encryption makes data unreadable, and geographic separation makes it unreachable within a single jurisdiction. Both tools are legal and widely used both in Russia and abroad.
